Overview - Architectural and Airbnb/Short-Term Rental Photography Services

These Terms and Conditions ("Terms") govern the provision of architectural, real estate and Airbnb/short-term rental photography services by Andrew Paranavitana Photography ("we", "us", "our") to any client who books, engages or pays for our services ("you", "the Client"). By booking a shoot, confirming a quote, or otherwise engaging our services, you agree to be bound by these Terms.

We reserve the right to update or amend these Terms at any time. The version in effect at the time a booking is confirmed will apply to that booking.

Services Provided
We provide professional photography services for architectural, interior, real estate and Airbnb/short-term rental properties, including but not limited to interior and exterior photography, twilight photography, drone/aerial photography (where licensed and permitted), and listing-ready image packages for platforms such as Airbnb, Booking.com, and real estate listing sites.

The specific inclusions, number of images, turnaround time and pricing for each shoot will be confirmed in writing (via email or invoice) prior to the booking being locked in. Any services outside the agreed scope (additional rooms, extra editing, rush delivery, reshoots not due to our error, etc.) may incur additional charges, which will be communicated to you before being carried out wherever possible.

Booking & Scheduling
A booking is only confirmed once you have accepted the quote and, where required, paid the deposit outlined below. Shoot dates and times are booked on a first-confirmed basis and are not held indefinitely.

You are responsible for ensuring the property is presentation-ready (styled, clean, decluttered, curtains/blinds set as desired, external areas tidy) at the agreed shoot time. If the property is not ready and this causes a delay or requires us to return for a second visit, additional charges may apply as outlined below.

Site Access
You must ensure we have access to the property at the confirmed time, including any keys, codes, or permissions required. If we are unable to access the property at the agreed time through no fault of ours, this will be treated as a late cancellation under the Cancellations & Rescheduling section below.

Payment Terms
Invoices are issued upon completion and delivery of the shoot, and payment is due within 14 days of the invoice date ("the due date"), unless a different payment schedule has been agreed in writing in advance.

We accept payment via bank transfer (details provided on the invoice). Full, final, high-resolution images and usage rights are only released once payment has been received in full. Low-resolution or watermarked previews may be provided prior to full payment at our discretion.

Late Payments & Fees
If payment is not received by the due date:

- A late fee of 5% of the outstanding invoice amount will be applied for each week (or part thereof) the invoice remains unpaid, up to a maximum of 20% of the original invoice total.
- We reserve the right to withhold delivery of any further images, files, or services (including any future bookings) until the outstanding balance, including any late fees, is paid in full.
- Accounts more than 30 days overdue may be referred to a debt collection agency or small claims process, with any associated costs (collection fees, legal fees, court costs) added to the amount owed by you.
- Continued failure to pay may result in the immediate termination of any ongoing service agreement between us.

If you anticipate a delay in payment, please contact us as soon as possible. We are generally willing to discuss a reasonable payment plan where communicated in advance of the due date, at our discretion.

Cancellations & Rescheduling
Cancellations or rescheduling requests must be made in writing (email or SMS is sufficient).

- Cancellations made more than 24 hours before the scheduled shoot: deposit may be credited toward a future booking, at our discretion.
- Cancellations made within 24 hours of the scheduled shoot, or failure to provide access at the agreed time ("no access"/no-show): the deposit is forfeited, and if the shoot has already commenced, the full quoted fee remains payable.
- Rescheduling due to weather (for exterior/drone/twilight shoots) will be accommodated at no extra charge where reasonable notice is given and is at our discretion depending on conditions.

Weather & Circumstances Beyond Our Control
For exterior, twilight, or drone photography, weather conditions affecting image quality or safety (rain, high wind, poor light, etc.) may require rescheduling. We will make reasonable efforts to notify you as early as possible and will work with you to find the next available date at no additional charge. We are not liable for delays caused by weather, government drone restrictions, or other circumstances outside our reasonable control.

Image Delivery & Turnaround
Estimated turnaround times for edited image delivery will be confirmed at the time of booking. While we make every effort to meet these timeframes, they are estimates and not guaranteed delivery dates unless expressly agreed in writing (e.g. for a rush/priority service, which may incur an additional fee).

Revisions & Additional Requests
A reasonable number of minor revisions (e.g. straightening, colour adjustment) to the originally agreed image set will be accommodated at no charge if requested within 7 days of delivery. Requests for additional edited images beyond the agreed package, reshoots due to changes at the property, or styling changes requested after the shoot will be treated as additional paid work.

Copyright & Usage Rights
Andrew Paranavitana Photography retains full copyright ownership of all images produced, in accordance with Australian copyright law. Upon receipt of payment in full, the Client is granted a non-exclusive, non-transferable licence to use the delivered images for the purpose agreed at booking (e.g. the specific property's real estate listing, Airbnb/short-term rental listing, or marketing of that property).

Unless otherwise agreed in writing, this licence does not permit:
- Use of the images for any property other than the one photographed;
- Resale, sublicensing, or transfer of the images to a third party;
- Use of the images in ways that suggest endorsement by, or affiliation with, Andrew Paranavitana Photography beyond what was agreed;
- Alteration of the images (including cropping or filters) beyond minor platform-required resizing, without our consent.

We reserve the right to use images taken for the Client for our own portfolio, marketing, website and social media purposes, unless the Client requests otherwise in writing prior to the shoot.

Client Submissions & Communications
Any feedback, briefs, styling instructions or other communications you provide to us in relation to a shoot may be used by us solely for the purpose of delivering the agreed services. You are responsible for the accuracy of any information (such as property access details, styling instructions, or special requests) provided to us.

Third-Party Platforms
Where images are intended for use on third-party platforms (Airbnb, Booking.com, real estate portals, MLS, etc.), you are responsible for ensuring the images meet that platform's specific requirements and for uploading them correctly. We are not responsible for how third-party platforms display, compress, or crop delivered images.

Disclaimer of Warranties; Limitation of Liability
We take all reasonable care in providing our services, but we do not warrant that our services will be uninterrupted or error-free, and we do not guarantee specific business outcomes (such as booking rates or sale price) resulting from the use of our images.

To the maximum extent permitted by law, Andrew Paranavitana Photography, its contractors and any associated parties will not be liable for any indirect, incidental, special or consequential loss or damage (including lost profits or lost bookings) arising from the provision of our services, except where such liability cannot be excluded under applicable Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.

Indemnification
You agree to indemnify and hold harmless Andrew Paranavitana Photography, its contractors, agents and employees from any claim, loss, damage or expense (including reasonable legal fees) arising from your breach of these Terms, misuse of the delivered images beyond the agreed licence, or your provision of inaccurate information relating to a booking.

Property Access, Safety & Insurance
You are responsible for ensuring the property is safe to access and photograph at the agreed time. We carry our own equipment and public liability insurance for our operations, but are not responsible for pre-existing property damage, hazards, or conditions not caused by us.

Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

Governing Law
These Terms are governed by and construed in accordance with the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

Changes to These Terms
We may update these Terms from time to time. The version provided or linked to you at the time of booking will apply to that booking. Continued engagement of our services after any changes constitutes acceptance of the updated Terms.
